1. ELIGIBILITY:
Facebook users who LIKE the Hanes Page and complete all required fields of the entry form on the Cruise in Comfort Giveaway (“Giveaway”) application and who are legal residents of the fifty (50) states of the United States or the District of Columbia age twenty-one (21) years or older at the time of entry are eligible to participate. Employees, officers and directors of Hanesbrands Inc. (“Hanes” or “Sponsor”), Night Agency, LLC (“Administrator”), Disney Destinations LLC (“Disney”), or any of their respective parents, subsidiaries, or affiliated companies, advertising and promotional agencies, web masters and web suppliers and persons engaged in the development of Giveaway materials, and immediate family members (parents, siblings, children and spouse, wherever they reside) and persons who live in the same household (whether or not related) as such employees, officers and directors, are not eligible to participate. Groups, clubs, organizations, commercial entities, and businesses cannot participate. By participating, you agree to these Official Rules and all decisions of Sponsor which are final and binding in all respects. Void where prohibited by law.
2. PROMOTIONAL PERIOD:
Giveaway begins on January 16, 2012, at 5:00 p.m. ET and ends on March 30, 2012, at 4:59:59 p.m. ET (the “Promotional Period”).
3. HOW TO ENTER:
Go to the Cruise in Comfort Giveaway application on the Hanes Facebook Page and click on the “Get Started” button. Select the Disney Cruise Line® vacation itinerary that you would like to win. You may take the short quiz or skip the quiz and go directly to the entry form. Complete the online entry form with your name, street address, e-mail address, telephone number, age range, apparel sizes and gender. Make sure you have read the Official Rules and click the box agreeing to them, then click on the “Submit” button to submit your entry into the Giveaway. If you took the quiz, then your entry submission will result in two (2) entries into the Giveaway drawing. If you skipped the quiz, your submission will result in one (1) entry into the Giveaway drawing. There is no penalty for wrong answers on the quiz. Limit one entry submission per person/e-mail address per day. For purposes of this limit, each “day” begins at 12:00 a.m. ET and ends at 11:59:59 p.m. ET for each calendar day of the Promotional Period, with the exception of the first day, which begins at 5:00 p.m. ET, and the last day, which ends at 4:59:59 p.m. ET. Additional entry submissions from the same person/e-mail address in a single day will be disqualified. Incomplete or garbled entries will be disqualified.
4. PRIZES:
A. GRAND PRIZE: On or about April 2, 2012, Sponsor will select one (1) Grand Prize winner in a random drawing from among all eligible entries received. Grand Prize winner will receive the Disney Cruise Line® vacation for four (4) persons that Grand Prize winner selected at the time of entry from among the following ten itinerary and departure date options:

If Grand Prize winner lives within approximately 200 miles of selected departure port (as determined by Sponsor in its sole discretion), the air transportation and ground transportation portions of the Grand Prize will not be provided and no additional compensation will be provided to the Grand Prize winner. Grand Prize winner is solely responsible for all costs and expenses of the Grand Prize vacation not specified as included in these Official Rules including, but not limited to, tips, gratuities, merchandise and souvenirs, shore excursions, equipment rentals, laundry service, spa treatments, alcoholic beverages, Palo and Remy service charges, Flounder’s Reef Nursery charges, local and long-distance telephone calls, ship-to-shore communications including internet, insurance, transportation between Grand Prize winner’s residence and the departure airport, baggage fees, port fees, and other personal expenses. Grand Prize vacation (including, without limitation, air transportation and stateroom accommodations) is subject to availability and additional restrictions. Travel arrangements must be booked through Sponsor at least 45 days in advance of intended travel dates. Grand Prize winner and all guests must travel on same itinerary. Grand Prize winner and guests are solely responsible for obtaining (and traveling with) proper citizenship documentation which may include passports, valid alien registration cards and/or necessary visas. Those without proper citizenship documentation will be denied boarding. If Grand Prize winner elects to take vacation with fewer than the allowed number of guests, components of the Grand Prize will be awarded in increments/quantities suitable for the actual number of travelers and Grand Prize winner will not receive any compensation or substitute/alternate prize for same. If any guest is a minor in his/her jurisdiction of residence, he/she must be accompanied on the vacation by his/her parent or legal guardian, who must be either the Grand Prize winner or another guest of the Grand Prize winner. Grand Prize winner is solely responsible for all federal, state and local taxes on the Grand Prize. At the appropriate time, Sponsor will issue an IRS Form 1099 in the amount of the retail value of the selected vacation listed above in these Official Rules. Grand Prize must be accepted with all listed prize components subject to the conditions indicated herein. Grand Prize vacation may not be sold, traded, transferred, refunded, commissioned or redeemed for cash value. Grand Prize vacation and its components may not be substituted; however, Sponsor reserves the right in its sole discretion to substitute prize (or any prize component) with another prize/prize component of equal or greater value if advertised prize/prize component becomes unavailable for any reason. Actual value of the Grand Prize may depend on city of departure, travel dates and other factors. Any difference between the estimated value of the Grand Prize and the actual value will not be awarded to Grand Prize winner. Grand Prize winner must take the cruise vacation selected in the winning entry form on one of the two dates indicated in these Official Rules for that cruise vacation or else the Grand Prize will be forfeited in its entirety. Changes are not permitted after airfare tickets are issued. Sponsor is not responsible for travel delays or cancellations. There shall be no compensation or prize substitution if Grand Prize winner or guests are unable to take scheduled cruise vacation by reason of illness, family emergency, personal events, terrorism, labor strikes, weather, or other acts beyond Sponsor’s control.
B. HANES VACATION WARDROBE PRIZE PACKAGES: On or about April 2, 2012, Sponsor will select ten (10) winners, who will each receive a Hanes Vacation Wardrobe Prize Package.

Approximate retail value of each men’s package is $217.00. Approximate retail value of each women’s package is $159.00. Sponsor expects to be able to honor size requests within the sizes stated above, however, Sponsor reserves the right to substitute a different size for a requested size should the requested size become unavailable for any reason. Style and color of garments are in Sponsor’s sole discretion and subject to availability.
Odds of winning a prize depend on the number of eligible entries received. Limit one prize of any kind per person/e-mail address/household address. No cash in lieu of prize. No prize transfer or substitution allowed; however, Sponsor reserves the right in its sole discretion to substitute prize (or any prize component) with another prize/prize component of equal or greater value if advertised prize/prize component becomes unavailable for any reason. Winners are solely responsible for all federal, state and local taxes on the prize. Total value of all prizes is between $9,500 and $14,870.
5. NOTIFICATION AND CONFIRMATION OF PRIZE WINNERS:
Potential winners will be notified via e-mail and/or mail within two business days of the drawing. Potential Grand Prize winner must sign and return an Affidavit of Eligibility and Liability/Publicity Release (where legal) and an IRS Form W-9 within seven days of receipt in order to claim prize. Potential wardrobe prize winners must sign and return a Declaration of Eligibility and Liability/Publicity Release (where legal) within seven days of receipt in order to claim prize. Each guest of Grand Prize winner (if a minor in his/her jurisdiction of residence, his/her parent or legal guardian) must also complete, sign and return a Liability Release and, where lawful, a Publicity Release before any travel arrangements can be made. If such documents are not returned on a timely basis, or if notification of prize is returned as non-deliverable, or if a potential winner of a prize is found to be ineligible or not in full compliance with these Official Rules, or if a potential winner declines a prize for any reason, then the potential winner will be disqualified and the prize will be forfeited. If forfeiture occurs during the process of confirming winners and awarding prizes, then Sponsor will select an alternate winner from among remaining eligible entries in order to award the prize. If, however, forfeiture occurs after prizes have been awarded and confirmed, Sponsor has no obligation to select and award the prize to an alternate winner. Wardrobe prizes will be shipped to the winner’s address within 8 to 10 weeks following confirmation.
6. GENERAL CONDITIONS:
In the event of a dispute as to the identity of an entrant, entrant will be deemed to be the individual registered through the application used to enter the Giveaway. Any attempt by an entrant or anyone else to deliberately damage any website or undermine the legitimate operation of the Giveaway is a violation of criminal and/or civil laws and, should such an attempt be made, Sponsor reserves the right to disqualify any such entrant and seek damages to the fullest extent permitted by law, in its sole discretion. Sponsor reserves the right, in its sole discretion, to void suspect entries, or to modify, cancel, or suspend the Giveaway should virus, bugs, non-authorized human intervention or other causes beyond the control of Sponsor corrupt or impair the administration, security, or fairness of the Giveaway, and to conduct the random drawings from among all eligible entries received prior to and/or after (as appropriate) the action taken by Sponsor or to otherwise make prizes available to be won in a manner deemed by Sponsor in its sole discretion, to be fair, appropriate and consistent with the spirit of these Official Rules. Any use of robotic, automatic, macro, programmed or like entry methods is strictly prohibited and will result in the disqualification of any entrant using such methods, in Sponsor's sole discretion. Sponsor also reserves the right in its sole discretion to disqualify any entrant attempting to use multiple e-mail addresses, street addresses, name variations or other personal information in order to generate more than one entry per day. By participating, you agree that the Sponsor, Facebook, Administrator, Disney, and each of their respective parents, subsidiaries, and affiliates, and all of their respective officers, directors, employees, representatives and agents, will have no liability whatsoever for any liability for any injury, loss or damages of any kind to persons, including death, or property, due in whole or in part, directly or indirectly, from the acceptance, possession, use or misuse of a prize or participation in this Giveaway or any prize-related activities. Sponsor assumes no responsibility for network, hardware, software, telephone, cable or other technical failures; or for incomplete, damaged, misdirected, illegible, garbled or lost e-mail or mail communications. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Giveaway or in the announcement of the prizes. By entering, you agree that Sponsor, and those acting under its authority, may use your name, photographs, likeness, voice, image, statements and biographical information for advertising and promotional purposes in any media without limitation and without further consideration, unless prohibited by law. Sponsor may, but is not obligated to, arrange to film or take photographs of portions of the Grand Prize vacation and experiences. In that event, Sponsor will be the sole owner of such audio-visual images and/or photographs with exclusive rights to post, display, edit, compile, publish, use, create derivative works from, and permit others to post, display, edit, compile, publish, create derivative works from or otherwise use such audio-visual images and/or photographs, including posting on the internet without additional compensation or obligation to winner or guests. If you elect to receive occasional updates, special offers and other information from Disney and its affiliated and associated companies about their products and services, your information may be shared with those companies. By participating, you agree to the Official Rules and the decisions of Hanesbrands Inc., which shall be final and binding in all respects.
7. DISPUTE RESOLUTION/CHOICE OF LAW:
Except where prohibited by law, participants agree that: (a) any and all disputes, claims, and causes of action arising out of or connected with these Official Rules or this Giveaway (and/or the rights and obligations of Sponsor and/or participant in conjunction therewith) (collectively, “Disputes”) shall be resolved individually, without resort to any form of class action; (b) any and all Disputes (excluding, for this purpose, any and all Disputes in any way related to the Giveaway Grand Prize) shall be resolved exclusively in an action in state or federal court in the State of North Carolina; (c) any and all Disputes in any way related to the Giveaway Grand Prize shall be governed by, and construed in accordance with, the laws of the State of Florida without regard for conflicts of law/choice of law doctrine of Florida or of any other jurisdiction and shall be resolved exclusively in an action in state or federal court in the State of Florida; (d) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Giveaway but in no event attorneys' fees; (e) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased; and (F) THEY WAIVE AND HEREBY DO WAIVE THEIR RIGHT TO A TRIAL BY JURY IN ANY SUCH ACTION. Except as provided above, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or this Giveaway (and/or the rights and obligations of Sponsor vis-à-vis participant and participant vis-à-vis Sponsor in conjunction therewith) shall be governed by, and construed in accordance with, the laws of the State of North Carolina without regard for conflicts of law/choice of law doctrine of North Carolina or of any other jurisdiction.
8. WINNERS LIST:
For the names of prize winners, mail a self-addressed stamped envelope to: Night Agency LLC, Hanes Cruise in Comfort Giveaway Winners List, 307 Canal Street, 2nd Floor, New York, NY 10013 between April 1 and April 30, 2012. Vermont residents may omit return postage. Allow 6-8 weeks for processing request.
